CA Business Retirement Plans

Advice & Planning for Maximum Benefits, Minimum Drawbacks for Your Specific Business- by Experienced San Diego Attorneys

San Diego Law Firm prepares retirement plans for business owners and employees. The laws regarding these are strict and must be carefully followed, but a good plan will not only offer you tax-free savings and provide for your future but also, if you desire, help you attract and retain skilled employees by offering a valuable benefit.  We can advise you on all your options and prepare a plan that suits your business and goals.

A Retirement Plan that Meets Your Goals

Different retirement plans offer different benefits and drawbacks; you'll want to choose one that most closely satisfies your needs and goals. You may be seeking the tax advantages or retirement security offered by many plans. You may be concerned about creating a plan that makes your business appealing to key employees, or you may just prefer a retirement plan for your employees that requires the least administrative responsibilities.

We'll help you evaluate the benefits and drawbacks of different types of retirement plans, including:

  • Plans that provide you with current tax deductions and the chance to grow contributed money tax free, with contributions not subject to taxation until distributed.
  • Plans that are most attractive to talented employees.
  • Plans designed specifically for older business owners that permit them to contribute substantial amounts to their retirement accounts.
  • Plans with minimal ongoing administrative costs and responsibilities (these differ depending on the plan selected).

As your attorneys, we'll help you evaluate your options and create the plan most closely aligned to your business needs and goals.

Qualified vs. Non-qualified Plans

While there are many different retirement plans available to you, an essential factor is whether the plan is “qualified” or “non-qualified.”  Consider the following:

  • A qualified plan creates valuable tax incentives for you and your employees.  To be eligible for these tax benefits and maintain the legitimacy of the plan, it is crucial that the plan comply with the Internal Revenue Code and the Employee Retirement Income Security Act of 1974, known as ERISA.
  • Retirement plans not meeting the applicable legal requirements are non-qualified plans.  Even though non-qualified plans don't provide you with these tax benefits, they may be useful as executive compensation for yourself or select employees, allowing you to defer additional compensation and the taxes paid on it until the future.

When meeting with you, our knowledgeable attorneys will explain your options, and prepare a qualified or non-qualified plan that closely achieves your personal and business objectives.
