CA Employment Contracts & Employee Handbooks:
Skilled, Experienced Help by San Diego Law Firm

Advice, Drafting of Employment Contracts, Nondisclosure Agreements, Employee Handbooks, Employment Manuals

Employment Contract

San Diego Law Firm also prepares written agreements which specify the terms of employment for a particular employee or category of employees.  Our attorneys have the legal and business knowledge needed to protect your business and promote its continued success, and an employment contract can play an important role in this.  We will consult with you about what types of contracts your particular business can benefit from.  Employee contracts we can prepare for your business include:

  • Written employment contracts that specify health benefits, vacation and sick leave, grounds for termination, and more.
  • Employee nondisclosure and confidentiality agreements, which are particularly useful to protect business processes, plans, formulas, data, or machinery, even after an employee leaves the business.
  • Invention assignment contracts, used where an employee (such as an engineer or programmer) is paid to be creative as part of his or her job. Generally, these agreements make the employee's inventions the employer's property.  They may also require the employee to help with patenting the inventions and keep information about the invention confidential.  They sometimes include a percentage of royalties to be paid to the employee, as an incentive to develop useful inventions during the employment.
  • Employee non-compete agreements that restrict an employee from working for competitors, soliciting your clients and customers, or starting a rival business for a certain period of time after leaving the company.  These are allowed in California law only to the degree they are absolutely necessary to protect an employer's trade secrets.

Employee Handbook and Employee Policy Manual

San Diego Law Firm can prepare or modify an employee policy manual or employee handbook to fit the requirements of your business and clearly establish employee and employer expectations.  These typically include leave policies, benefits, discipline policies, type of clothing permissible or required at work, use of email and telephone, and many other things.

We prepare these very carefully and take many factors into account that you might not be aware of in order to protect you in the future.  This is important because employee policy manuals can be enforced as a contract against the employer if not carefully written, or if other legal requirements are not followed.  We will advise you about preventing these pitfalls that can hurt your business.
